A San Mateo County jury on Friday found a real estate manager accused of beating his elderly employer to death at his former employer's posh Millbrae home guilty of two counts of first-degree murder. Joseph Cua, 54, of Burlingame killed retired restaurant owner Fernando Fernandes and his investors on June 13, 2006, and was found guilty Friday by a San Francisco Bay Area jury of one count of murder and one count of assault with a deadly weapon.
Wearing a neat charcoal grey suit, Cua greeted the news of Friday's verdict with the same composure he displayed during his four-week murder trial. Harm said that at first only a jury doubted he had committed murder at all, but that the individual quickly accepted the majority opinion after sleeping on Thursday night.
Defense attorney Edward Pomeroy argued throughout the trial that two key factors were presented as evidence of his client's actions: bloody footprints that did not match the shoes. Cua was wearing blood on his shoes on the day of the murder. While prosecutors said he was the last person to see Wagner alive, the defense argued that both had happened near her body and that he fled the scene when he realized he was suspected of murder.
Outside court on Friday, Gallagher said the tragedy of the murder had become "pathetic and sad" because Cua, who once served as trustee of the Wagner estate, no longer controlled the peninsula that made up the couple. At the time of the murder, Gallagher said he was leading a "completely divided - divided" life.
Citing witness statements that investigators found blood and DNA from Cua in the Wagner family's apartment, he said the evidence at the scene led to a quick decision. Prosecutors said she was naked from the waist down and had a cut in her vagina.
The defense said it would appeal the decision and consider a request for a new trial. Prosecutor Sean Gallagher said he was satisfied with the verdict and told jurors that a quick murder case was about money.
